KÄRCHER ARABIA CLEANING SYSTEMS L.L.C, trading as Kärcher Center Dubai – Branch of Kärcher (FZE), a company incorporated in United Arab Emirates, having its registered office in PO Box 17416 Dubai, UAE or any subsidiaries or affiliates thereto, as the case may be (Kärcher ), operates and maintains this Website and other Kärcher Websites that are linked to this site (collectively 'the Websites') and all the information, communications, software, scripting, photos, text, video, graphics, music, sounds, images and other materials and services found on the Website (collectively 'Content'), for the use of its customers, employees and members of the general public but only for the lawful purposes described below. Such content is provided by Kärcher as a convenience to its customers and to the general public.

We also occasionally have links to third party sites. Kindly note that the content of such third party sites are not under our responsibility and we are not responsible with regards to the content or accuracy of material on such sites. Please note that you follow such links entirely at your own risk.

Your Status: By placing an order through our site, you warrant that: (a) you are legally capable of entering into binding contracts; and (b) you are at least 18 years old.

1. 1. Order Placement and Cancellation

1.    1.1 Your submission of an order through this website constitutes an offer to purchase the selected products in accordance with these Terms and Conditions.

2.    1.2 Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us. The contract between us (Contract) will only be formed when we dispatch the product(s) to you.

3.    1.3 Kärcher reserves the right to accept or reject any order, in whole or in part, at its sole discretion.

4.    1.4 For details regarding cancellations prior to delivery, please refer to our Returns & Cancellation Policy .

5.    1.5 Kärcher reserves the right, at its sole discretion, to limit the quantity of products purchased per person, per household, or per order.
   
   

2. 2. Pricing & Payments

2.    2.1 All prices are stated in local currency as indicated in the checkout page with the Value Added Tax (VAT) are explicitly stated.

   1.    2.2 Payment in full is required at the time of order via our secure online payment gateway.

   2.    2.3 Goods shall not be dispatched or released until full payment has been successfully processed and confirmed.
      
      

3. 3. Shipping & Delivery Policy

3.    3.1 Delivery timeframes displayed on the website are estimates only and do not constitute a binding obligation.

   1.    3.2 Kärcher will make all reasonable efforts to meet the indicated delivery period; however, delays caused by circumstances beyond our reasonable control shall not give rise to liability or cancellation rights.

   2.    3.3 The risk of loss or damage to the goods shall pass to the Buyer upon delivery at the address specified in the order.

   3.    3.4 If delivery cannot be completed due to the Buyer’s unavailability or incorrect address, re-delivery charges may apply.
      
      

4. 4. Inspection of Goods

4.    4.1 The Buyer shall inspect the goods immediately upon receipt.

   1.    4.2 Any claims for visible damage, manufacturing defects, or order discrepancies must be submitted to Kärcher in writing within seven (7) calendar days of receipt.

   2.    4.3 Failure to notify Kärcher within this period shall constitute unconditional acceptance of the goods.
      
      

5. 5. Returns, Refunds, and Cancellation Policy

5.    5.1 Unused and undamaged goods in their original, unopened packaging may be returned or exchanged within thirty (30) calendar days from the date of purchase, subject to presentation of the original purchase receipt.

   1.    5.2 Refunds for online payments will be processed to the original method of payment only.

   2.    5.3 Return shipping and handling costs will be deducted from the refund amount.

   3.    5.4 Refunds shall be processed only after receipt and inspection of the returned item at Kärcher ’s warehouse.

6. 6 Warranty After-Sales Support

6.    6.1 All products sold through this website are covered by Kärcher ’s standard manufacturer’s warranty against defects in materials and workmanship for a period of one (1) year from the date of purchase, applicable only within the country of purchase.

   1.    6.2 Any faults shall be corrected either by repair or by replacement, whichever Kärcher judges to be appropriate. Any components replaced shall become the property of Kärcher. A warranty repair or replacement does not extend or restart the original warranty period. The warranty is void if the serial number is removed. Warranty claims require the machine to be sent complete with all its accessories as deemed necessary by Kärcher Service team.

   2.    6.3 The warranty does not apply to:
      
      

1.       A) Misuse, neglect, accident, abuse, improper handling, or non-compliance with the user manual

2.       B) Normal wear and tear of consumable parts, accessories, or attachments

3.       C) Use of devices or accessories not distributed or approved by Kärcher (which shall void the warranty)

4.       D) Repairs, alterations, or modifications carried out by unauthorised persons or service centres

5.       E) Defects caused by the use of incorrect supply voltage

6.       F) Improper installation or insufficient maintenance

7.       G) Use of cleaning agents not approved by Kärcher

8.       H) Damage from external influences (e.g., vandalism, natural catastrophes, fire, weather)
   
   

1.    6.4 The original proof of purchase must be presented to claim warranty service.

2.    6.5 The warranty is non-transferable and applies only to products purchased through authorised Kärcher channels in the local country of purchase.

7. 7. Limitation of Liability

7.    7.1 To the fullest extent permitted by applicable law, Kärcher shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, revenue, or business opportunities.

   1.    7.2 Kärcher ’s total cumulative liability for any claim arising out of or relating to the sale or use of its products shall not exceed the net sales price of the goods in question.
      Except as expressly stated herein, all other warranties, express or implied (including those of merchantability or fitness for purpose), are hereby excluded.
      
      

8. 9. Title to Goods

Ownership of the Goods will only pass to you when we receive full payment of all sums due in respect of the Goods, including any delivery charges. Risk in the Goods passes to you upon delivery.

8. 10. Intellectual Property & Confidentiality

All content displayed on this website, including but not limited to text, images, logos, designs, and graphics, is the intellectual property of Kärcher and is protected under applicable copyright, trademark, and other intellectual property laws. No material may be reproduced, copied, or distributed without prior written consent.

9. 11.Force Majeure

Kärcher shall not be liable for any delay or failure to perform our obligations under these terms if such delay or failure is caused by a Force Majeure event, including but not limited to acts of God, war, pandemic, or significant disruption to transportation networks, that is beyond our reasonable control.

10. 12. Privacy Policy

Your privacy is important to us. Our Data Privacy Policy forms part of these Terms and explains how we collect, use, and safeguard your personal data when you interact with our website and services.

11. 13. Governing Law & Jurisdiction

This agreement and any resulting contract shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai. The parties agree to the exclusive jurisdiction of the Dubai Courts.

12. 14. Severability

If any provision of these Terms is held to be illegal, invalid, or unenforceable, such provision shall be fully severable, and the remaining provisions herein shall remain in full force and effect.

13. 15. Transfer of Rights and Obligations

The Contract between you and us is binding on you and us. You may not transfer, assign, or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent.

14. 16. Waiver

Our failure to insist upon the strict performance of any of your obligations under the Contract or these Terms and Conditions shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

15. 17. Entire Agreement

These Terms and Conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, or agreements relating to the subject matter of any Contract.
